Palikir, Pohnpei — President Wesley W. Simina has vetoed legislation that would place new limits on presidential authority and emergency spending during declared emergencies, along with a separate measure that would establish monthly housing stipends for exempt employees of the FSM National Government.
Both measures have been returned to the 24th FSM Congress for further consideration.
The first, Congressional Act No. 24-119, would amend portions of Title 41 of the FSM Code dealing with emergency powers and presidential authority, including the use of emergency funding during a declared state of emergency.
Simina said the measure could restrict the Executive Branch’s ability to respond quickly during major emergencies, mobilize resources and provide timely assistance to affected states and communities.
He also raised concerns about the separation of powers and about a proposed $200,000 limit on emergency funding, saying the limit might not provide enough flexibility to respond effectively to a large-scale disaster requiring immediate national action.
The second vetoed measure, Congressional Act No. 24-103, would establish a monthly housing stipend for exempt employees of the National Government and exempt those employees from existing housing regulations.
Simina acknowledged the measure’s intent to support government employees but said further consideration is needed because of concerns about its fiscal impact, implementation and equitable application across the public service.
In announcing the vetoes, the President said his decisions were part of his constitutional responsibility to review legislation before it becomes law and to ensure that enacted measures are consistent with the FSM Constitution and serve the country’s long-term interests.
The Simina-Palik Administration said the President remains committed to working with Congress to address the concerns raised in his veto messages and develop legislation that serves the national interest.
Under Article IX, Section 22 of the FSM Constitution, the President has authority to veto legislation passed by Congress. Both measures have now been returned to the 24th FSM Congress for further consideration.
